How do I get custody of my child?
Custody is a very misused term in family law. Most people think it refers to the amount of time you spend with your child, but in fact it relates to the decision-making rights that have to do with your child. Often, separated spouses fight about custody when there are not really that many decisions to make involving the child. A lawyer can look closely at your case and help you find a tailored solution to the problems that are most likely to arise between you and your ex-spouse. Often, creative solutions can be found to questions regarding custody.
You should also be aware that the Government of Canada has proposed changes to the Divorce Act that will eliminate the use of the word custody entirely. You can learn more about the proposals here.
